Rule 31
To apply for certificate
(1) According to Section 31 of the Act, any person, firm or company who wishes to obtain a digital signature certificate shall submit an application to the certifying body in the format as per Schedule-5.
(2) The certifying body shall carry out the necessary investigation on the application received in accordance with sub-rule (1). While examining in this way, the following things should be examined in particular:-
(a) whether the application received is official and lawful or not.
(b) Whether or not the applicant is on the suspect customer list,
(c) grounds on which the certifying body is satisfied that the applicant is capable of using such certificate on his own without the assistance of any other person,
(d) whether or not the applicant has consented to the publication of details of the certification in the directory,
(e) Whether the authenticity of the identity has been checked or not based on the details of the verification process submitted by the applicant (3) During the investigation according to sub-rule (2), if it is deemed necessary to request any additional details from the applicant, the certifying body may request such additional details from the applicant.
(4) It shall be the duty of the concerned applicant to submit the additional details requested as per sub-rule (3) to the certifying body.
